When an entrepreneur decides to create his business in Morocco, one of the first essential steps is to choose the address of his head office. This is what we call business domiciliation. Far from being a simple formality, it conditions registration in the Commercial Register, obtaining the tax identification number, affiliation with the CNSS and all administrative procedures linked to the life of the company.

The domiciliation establishes the official address of the company. It appears on all legal and commercial documents, and also determines the competent jurisdiction in the event of a dispute. In other words, the registered office is not just an address, it is the legal identity of the company.

In Morocco, domiciliation has long been perceived as complex or rigid, particularly for young entrepreneurs. But an important development occurred with the law 89-17 relating to the organization of business domiciliation, published in the Official Bulletin. This law now clearly regulates the activity of domiciliation companies and sets out their obligations. For example, it requires the signing of a written contract between the company and the domiciliation company, filed with the registry of the commercial court, specifying the duration, the services provided and the commitments of each party. It also strengthened the guarantees in terms of transparency and traceability, by requiring domiciliaries to keep a register of hosted companies and to provide the necessary documents to the tax and judicial authorities in the event of an audit.

This reform aims to modernize the legal framework, secure relations between entrepreneurs and domiciliaries and encourage business creation. Thanks to it, domiciliation has become a much more flexible and attractive tool, particularly for VSEs, start-ups and foreign investors who wish to quickly establish themselves in Morocco without incurring high real estate costs.
